1. Introduction and Acceptance of Terms
Welcome to Auris Nexus Sdn Bhd (“we,” “us,” or “our”). By accessing or using our e-commerce platform, website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using our Platform. If you do not agree to these Terms in their entirety, you must not access or use our Platform. Your continued use of the Platform following any modification to these Terms constitutes your acceptance of the revised Terms.

For the purposes of these Terms, the following definitions apply:
“User” or “you” refers to any individual or entity that accesses or uses the Platform, whether as a buyer, seller, or visitor. “Account” means the registered profile created by a User to access the Platform’s features and services. “Products” means any goods, digital items, or services listed for sale on the Platform. “Transaction” means any purchase, sale, or exchange of Products facilitated through the Platform. “Content” means any text, images, videos, reviews, data, or other material submitted to or displayed on the Platform. “Seller” means any registered User who lists Products for sale on the Platform. “Buyer” means any registered User who purchases Products through the Platform.
3. Eligibility and Account Registration
3.1 Eligibility
To use the Platform, you must be at least 18 years of age, or the age of majority in your jurisdiction. By creating an Account, you represent and warrant that you meet all eligibility requirements. By registering as a User of this Site, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service in their entirety, together with all documents incorporated by reference therein, and you provide your informed consent to the processing of your personal data as set forth in the applicable Privacy Policy.
3.2 Account Registration
You are required to create an Account to access certain features of the Platform. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your Account information to keep it accurate and complete.
- Keep your password confidential and not share it with any third party.
- Immediately notify us of any unauthorized use of your Account.
We reserve the right to suspend or terminate any Account that contains false or misleading information, or that violates these Terms.
4. Orders, Purchases, and Payments
4.1 Placing Orders
By placing an order on the Platform, you make an offer to purchase the selected Products at the listed price. All orders are subject to acceptance by the Seller and availability of the Products.
4.2 Pricing
All prices displayed on the Platform are in Ringgit Malaysia unless otherwise stated. Prices are subject to change without notice. We do not guarantee that the prices listed are the lowest available in the market. Applicable taxes and shipping fees will be calculated and displayed at checkout.
4.3 Payment
We accept the following payment methods: credit/debit cards, digital wallets, and other methods as indicated at checkout. By submitting payment information, you authorize us to charge the applicable amount. All payments are processed by third-party payment processors, and their terms and privacy policies apply.
4.4 Order Confirmation
An order confirmation email will be sent upon successful placement of your order. This confirmation does not constitute acceptance of the order. Acceptance occurs when the order is dispatched or when a digital product is made available for download.
5. Shipping, Delivery, and Risk of Loss
Shipping timelines and fees vary by Seller and delivery location. Estimated delivery dates are provided for guidance only and are not guaranteed. Risk of loss and title to purchased Products passes to the Buyer upon delivery of the items to the carrier. We are not responsible for delays caused by carriers, customs, or events beyond our control.
6. Returns, Refunds, and Cancellations
6.1 Return Policy
Return eligibility is subject to the individual Seller’s return policy, which will be displayed on the Product listing. Unless otherwise stated, Products may be returned within 14 days of delivery, provided they are unused, in original packaging, and accompanied by proof of purchase.
6.2 Refunds
Refunds will be processed to the original payment method within 5 working days of receiving and inspecting the returned item. We reserve the right to refuse refunds for Products that do not meet the return conditions.
6.3 Cancellations
Orders may be cancelled before they are dispatched. Once an order has been shipped, it cannot be cancelled but may be returned in accordance with the Refund Policy.
7. Seller Responsibilities
Sellers who list Products on the Platform agree to:
- Provide accurate, truthful, and complete descriptions of all Products.
- Ensure Products are lawful to sell and do not infringe any third-party intellectual property rights.
- Fulfill orders promptly and communicate with Buyers in a timely manner.
- Comply with all applicable laws, regulations, and Platform policies.
- Not engage in price gouging, deceptive practices, or any conduct that harms Buyers or the Platform’s reputation.
We reserve the right to remove listings, suspend, or terminate the accounts of Sellers who violate these obligations without prior notice.
8. Prohibited Conduct
You agree not to use the Platform to:
- List, sell, or purchase illegal, counterfeit, hazardous, or prohibited goods or services.
- Engage in fraud, misrepresentation, or any deceptive practices.
- Harass, abuse, or harm other Users or our employees.
- Violate any applicable laws or regulations.
- Use automated tools, bots, or scrapers to access or collect data from the Platform without our written consent.
- Introduce malicious software, viruses, or harmful code into the Platform.
- Attempt to gain unauthorized access to our systems or another User’s Account.
- Circumvent any security or access controls on the Platform.
9. Intellectual Property
All content, features, trademarks, logos, and technology on the Platform are owned by or licensed to Movo and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written permission. By submitting Content to the Platform (including product reviews, images, or descriptions), you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such Content in connection with the operation and promotion of the Platform.
10. Privacy and Data Protection
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and sharing of your personal information as described in our Privacy Policy. We comply with applicable data protection laws, including the Personal Data Protection Act 2010 (Malaysia).
11. Disclaimers and Limitation of Liability
11.1 Disclaimer of Warranties
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION CONDUCTED THROUGH IT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE TRANSACTION GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Movo and its officers, directors, employees, agents, and partners from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
13.2 Dispute Process
In the event of a dispute, we encourage you to contact our customer support team first. If the dispute is not resolved within 30 days, either party may initiate formal proceedings in the courts of Malaysia.
13.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
14. Modifications to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of the revised Terms constitutes acceptance of the changes.
15. Termination
We may suspend or terminate your Account and access to the Platform at any time, with or without cause or notice if it is found that your account has suspicious activities. You may terminate your Account at any time by contacting customer support. Upon termination, all licenses granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination shall remain in full force and effect.
